GENERAL DISCLOSURE FOR THE EMPLOYEE CANDIDATE
This general disclosure document regarding the personal data process (“General Disclosure Document”) has been drawn under the 10th Article of Law on Personal Data Protection no. 6698 to define the methods and purposes of process your personal data by TOGG.
The personal data collected upon your job application to TOGG might be processed in compliance with the Law and the related regulations including but not limited to the following points by TOGG. You can obtain information on the Employee Candidates’ personal data which might be processed in the capacity of data supervisor by TOGG and the methods and purposes to process them, the persons to whom they might be transmitted, collection method and legal reasons and your rights on such personal data by reviewing this General Disclosure Document.
The personal data to be processed, their process purposes and the parties they have been transmitted are discussed within transparency for our Employee Candidates in this General Disclosure Document which we have drawn to inform. The applied position, working conditions or their explicit consent, etc. might differ for any person, the following information shall not be binding for every employee candidate.
Your Personal Data
Your personal data means the information which identify your identity or which make it identifiable. As an Employee Candidate, your personal data which might be processed during the recruitment process are discussed below including but not limited to the following elements:
a) Your resume including your name and surname, ID Card No., birth date and birth place, your gender, social status and nationality,
b) E-mail address, mail address, the province/district, mobile and/or home phone number,
c) Educational background, certificate and course information you have taken place, foreign languages, your detailed experiences, computer skills, your references (the name/surname/title/workplace/phone/e-mail of your reference), driving license details, your abilities, hobbies, salary expectation, military background,
d) The applied position and application channel,
e) The information you have shared within the scope of the application and during the negotiations and your records regarding the negotiations,
f) The information obtained as the result of the researches to be conducted by TOGG,
g) Personality test results,
h) Assessment regarding the recruitment application and your result of job application.
Data Supervisor
Your personal data might be processed by TOGG as the data supervisor in the methods specified in this General Disclosure Document.
The Purposes to Process Your Personal Data
Your personal data within the scope of TOGG HR recruitments might be processed including but not limited to the following parameters:
a) To carry out the recruitment processes and assess the applications,
b) To make job proposal and assess position, salary and secondary rights,
c) To carry out the HR activities (restoring the resume details in the pools, etc.)
d) To control, supervise, analysis and improve the HR processes,
e) To fulfill the legal obligations,
Transmission of the Personal Data
Your personal data might be shared with the third persons in compliance with the regulation to ensure the purposes specified above. The related personal data within this framework might be shared with third parties such as contractor firms with whom cooperation for recruitment is ensured within the scope of the General Disclosure Document; survey and research firms, contractors from which support on human resources, accounting and social security have been provided and authorized judicial and administrative institutions and establishments including but not limited to the domestic and international related persons and institutions.
Private Personal Data and Usage Purposes
Within the scope of the Law on Personal Data Protection, the data on nationality, ethnicity, political idea, philosophical belief, religion, sect and other believes, appearance, membership for association, foundation or union, health, sexual life, penal sentence and security measurements and biometric and genetic data are considered as private personal data.
Information and documents such as health report, criminal record required to be stored in terms of business scope during the employment upon the positive outcome of the recruitment might be demanded from the Employer Candidate and such private data shall be considered within the scope of confidentiality.
In case of exceptions if your private personal data is required to be collected for recruitment, your personal data might be processed, stored and shared with the related parties, institutions and establishments in compliance with the regulation on the personal data protection with the legitimate purposes to ensure the protection of the occupational health and safety and fulfill the obligations of the service relations and the legal obligations born by the related TOGG Business Law no. 4857, Law on. Occupational Health and Safety no. 6331 and other regulations if required by the legal regulations and company liabilities and/or within your explicit consent regarding the subject.
Methods and Legal Reason of Collecting Personal Data
Your personal data, job applications made in-house or via external sources, face-to-face or distant job interviews and negotiations might be collected, processed and transmitted based on the purposes specified above in compliance with the Labor Law and other legal reasons specified in the regulation required by the 5th and 6th articles of the Law or upon your approval via information collection channels as in written, verbal or electronically and other media of TOGG HR partners for Employee Candidates.
Your Rights to Personal Data Protection
We would like to remind you that you have right to
- learn whether their personal data have been processed or not,
- demand information if their personal data are processed,
- learn the purpose of possessing your personal data and whether they are used according to their purpose or not,
- know the third persons in their country and in abroad to whom your personal data have been transmitted,
- request the correction in case your personal data is processed deficiently or incorrectly,
- demand your personal data to be removed or eliminated within the framework of the provisions specified in the 7th article of the Law,
- demand the third parties to whom your personal data is transmitted to be informed about the processes carried out under your rights to edit, remove or eliminate specified above,
- oppose to the result against you because of the analyses carried out for your personal data with the exclusive automatic systems,
- demand for compensation if you get harmed because your personal data is processed against the law.
By applying to TOGG under the 11th article of the Law. Despite of the exercise of the rights specified under the 11th article of the Law, TOGG reserves the right to assess such demands within the scope of the regulation and provide any positive/negative reply.
Your personal data might be required to be stored and processed in order for TOGG Human Resource activities to be carried out actively and in full.
